Islamic marriage advice and family advice

I am married, but want to marry again

I am a muslim woman. My marriage has been over for over 2 years, and we have not been living with each other for a year, but he never gave me a divorce. He treats me like a slave, and lives with his girlfriend.  I am from Iran, and in my country he should give a divorce. I hid myself from him in Turkey.

I recently met a nice muslim single guy who fell in love with me, and wants to marry me. We never had sex yet. We want to find a solution, but we are living in Turkey right now and it's illegal to marry a married woman here. Is there any place that we can marry legally?  Please help me.

  1. Sister ,

According to Islam you can't get married to new man as you are still married .Islamic principles remains the same in all the countries and regions .

Only way for you to get married again is to take divorce first and then wait for Iddath period post divorce that is 4 months 10 days .Once you finishes your iddath period then only you can get married .

  2. If your husband will not divorce you you can ask for Khula. Can you go back to Iran to ask for Khula? Your divorce would probably need to happen in Iran where you were married. You have good reason for Khula as you and your husband have been separated for two years. It sounds like he is just hanging on to you for control. Wait until you have a final divorce , then you can marry. Do not have contact with this man until you can marry him as it is haram. I doubt you can ask for Khula in Turkey but maybe you can. So its best to travel to Iran and seek Khula there if that is possible. You have rights to live a new life, but you need to get divorced first. Iran is strict. Do you even have right there to leave your husband without divorce? If you have fled abuse or violence you should have a lawyer help you get khula from Turkey.

  3. It sounds like you are hiding from him. If you can expand on your story here better advice can be giving. It sounds like you fled Iran to get away safely. Then you should only go back there for khula if you have someone to protect you and actually you may be forced to be with your husband if you go back there because of the laws there. How did he treat you as a slave? I am sad for your suffering and this is wrong but many women are treated like slaves by men. Were you born in Iran? The safest thing seems to get khula from Turkey with a good lawyer to assist you. You need to be able to live your life now and live a true Islamic life. It can bee complicated in these situations with abusive situations. May Allah bless you sister . Im sorry for your suffering.

  4. Assalam alaikum,

Speak to a Muslim lawyer or Judge or an Imam in Turkey--let them know that you are hiding from you husband and your circumstances. They would be able to guide you better as this is a very serious case.

May Allah ease your problems, Ameen.

    • Musleh, please register and submit your question as a separate post, and we will answer you in turn, Insha'Allah. Keep in mind that we can advise you, but we do not function as a matchmaking service.
