Am I free to re-marry after separating from Christian husband and reverting?

law fiqh marriage divorce

Assalamu' alaikum

I am a married christian and separated for 5 years now, we are not legally separated, annulled or divorced but we agree to be separated.

Just convert into islam and there is a muslim guy who wants to marry me.

Is it possible for us to be married since I am not yet annulled from my previous marriage?

  1. Walaykumsalaam Narmin,

Maasha'Allah on your reversion to Islam, may Allah make this journey easy for you, aameen.

Depending on the law of the land, you would most probably need to get a legal divorce otherwise you may be charged with polygamy - and you don't want that! With regards to when you can re-marry, please consult with a qualified Imam.

  2. salamu'alaikum sister,

If you have reverted to Islam, while your husband is still a non Believer, then inform him of your reversion and see if there are chances that you call him to the Path of Allah, which leads to His Pleasure. If he agrees, then he has more right over you than the Muslim guy you mentioned.if he refuses, then complete the legal formalities of a divorce if required in your country. Otherwise, he is no more your husband as per the Sharee'ah, once you cross the waiting period called 'Iddah, which is, I think three months (from the time you accepted Islam)

After the waiting, insha Allah, according to the Sharee'ah, you can marry another man. But please look into the issue of divorce first.

Further, the Nikaah is not possible, until the girl has a Wali (Guardian) from her side (Nikaah is invalid without a Wali). If you have a responsible Muslim relative, he can act as one. Otherwise, a Muslim person with authority in your area, or a 'Aadil (Just) Muslim person, or an Imam, can act as the Wali.

This was, in case the occasion of Nikaah is what Allah has destined for you.

I hope this was of some help.
May Allah keep you, me and all the Muslims steadfast on His Religion, until we meet Him
    Aameen
    Wassalamu'alaikum
