Can I get a Khul’ah divorce?

Assalamualay-kum

I was forced into marriage in 2006. I was forced because i did not want to marry my mother's first cousin in pakistan. He wanted to come to the Uk to study.

We did not sleep together and since coming to the Uk he has disappeared to his sisters house.

I would like to move on with my life and be given a khullah.

Is this possible as i do not know where he lives. Will i be granted a khullah as i have not seen him for the last three years? i was not allowed to consider giving him a divorce before but now my family agree we shouldnt have been married in the first instance.

Please help me

jazakAllah

  1. Salam,

I am a Lawyer from Pakistan. You can get Khullah ( Divorce ) from Pakistani Court on the grounds that you were forced into marriage; 2nd is your husband disappeared since last 3 years, 3rd not providing maintenance to you.

Your presence in the court is not essential you will appoint special power of attorney who will appear in the court on your behalf.
