How to divorce a non-Muslim wife?

Divorce decree

False Divorce Paperwork

As far as i know, if a  married, non-Muslim guy converted to Islam, his marriage is still valid even if the wife remain Christian. What if the guy does not want to continue the marriage anymore? Is it valid if he pronounce talaq to his non-Muslim wife? how to deal with it in a country that doesn't allow divorce? does it goes under the Islamic law, or the civil law?

  1. Salaams,

A Muslim man, whether he be a convert or a born Muslim, pronounces divorce by talaq in any case. If a convert man wishes to divorce his Christian wife, he would still pronounce talaq to her just the same as if she were a Muslim. This is the only way to enact a valid divorce in the eyes of Allah. The Christian wife would still have a period of iddah before the divorce is final, whether she observes it or not.

Allah will recognize divorce by talaq even if the government doesn't. So to be correct religiously, you must do it this way. However, If there is marital property to be divided or custody issues, it's best to also pursue a divorce through the state to make sure that all things are settled properly for both party's sake. If you live in a country that doesn't allow divorce (like the Philippines, I believe), then you would probably have to remain legally married while Islamically divorced. In such a case you could take another wife with an Islamic nikkah, but that new marriage would never be recognized in the eyes of the state so long as the prior marriage remains on record. This situation could cause some complicated problems, particularly if your first wife didn't want the divorce to begin with.
