Is he required to maintan support for the children after an annullment?
Assalamu-alikum,
I am a Muslim woman married to a Hindu man who converted his religion to Islam. We got married as per Islamic laws. Recently I got a fatwa on the basis of the facts that my husband again started to practicing Hinduism after a few years of marriage. And he had been physically and abusively torturous to me and to my two kids(14 yr old boy,12yr old girl). The Fatwa has annulled my marriage to him. A case is against him is in civil court under violence against women. My question to you is, am I entitled for maintenance for my kids upbringing as per the Islamic law? He was also previously married which he did not disclose. The Fatwa was granted on 30 .01.13. I am residing right now in Chennai and the case against him in Chennai district court. I am a very troubled and distressed woman, oppressed by him for so many years. I am indeed very happy about the Fatwa .Allah has indeed been kind to me. Kindly advise as he should not go scotfree of his duties as a father.

Sorry to hear this usual turning husband story and the problem in yr life.
The main point here is if you seek support for yr duaghters you will have to be ready for the interference of yr husband in their lives.
And that inference will cost you their imaan which be effected due to his hindu influence and that is the greatest loss.If you want their iman to be intct you must be 400 kms away from him and his idol worship.
and the rituals or else they will jump from here to there and from there to here and they will not know what they are doing and finally their innocence will be spoilt with hindu influence and they might not get any good rishta because of the confusion.So if you have the capacity to look after them then dont go after him.
He will definitely create chaos in your life and the children will be either loosing the ethics of Islam or turn fully that side as i have seen the blood works in the acts of a human being from their forefathers so they are safe without him and his influence.
You also will lead a tension free life or else you have not seen the settlements of courts takes yeasr to get and after that he wont pay anything in time one month payment will jump to3/4 months and that also with reminders by notice for dafault.
And recently one girl whom i know very well i had to literally collect zakath from freinds and put mine put together paid for 17 to 18 months and the date in court didnt come due his excuses to attend court and finally she withdrew the case due to the lady police inspector not sending the files to court for lack of payment from the girl which is expected in every step to reach the whole case to the table of the judge and then the trouble of the boy side starts for non payment.
Finally disgusted with our great procedure -of our indian police and their understanding the girls plight and their rough treatment and their good understanding of her 3 childrens school fees auto charges daily expences monthly expences inspite of they being women and having family and children. they are least bothered and when ever you call they are on special duty for dasara and not available for 6 days 8 days.
My Allah save you from the torture in the path of this maintenance and not only that the person will put up a remark on your character openly[samething happened with girl i mentioned] in the court and say he is not entitled to pay for unfaithful wife and quote the same reason for his renouncing Islam and going back to hinduism.
instead of facing the torture and risking the iman of the girls it is better you live independantly .....

Very good advice brother. The indian judicial system is horribly corrupt...justice is always delayed, and justice delayed is justice denied.
