What is the best way to divorce my husband?

Divorce decree

Assalama Alaikum,

I am a Filipina married in Phillipines 2 years ago and I had one son with Syrian guy.

Unfortunately, there are many differences about me and him. Personality differences, inability to sustain my financial needs, poor in hygiene, etc.

Now we are leaving to go to his country. I want to get divorced and Inshalla, if there is a right man for me in the future, there is no problem in my status. And also what are my rights for my baby? Can I file a divorce in his country or in my country?  Please help me in your advice.

Thank you so much!

~Lyn

  1. Lyn,

Have you ever sat down with your husband and told him how you feel? He may not even be aware of some of the feelings you possess. Before looking to divorce as an answer to your situation, I would advise you to sit down and talk together, lay your cards on the table so to speak.Together you both have a beautiful child and with some work, you both might be able to save your relationship and your marriage.

  2. Salam sis,

Remember your husband holds the final word for divorce. But, if your husband is in the wrong, tell your Sharia Authority, let them investigate. When they do, they will force your husband to divorce you. I dont know in your country, but my country does that. Your baby may be looked after you, your husband pays his Nafkah

But, don't look for divorce as solution. Sit and talk first. Divorce is halal but hated by Allah remember that.

    • Zayn, this is incorrect.

The woman also has the right to seek divorce from the courts if she has reason to.
