Questions about divorce in Dubai

Hi,

My wife and I have been separated for 5 years. We are from the Philippines and we are now here in Dubai.  She converted to Islam 4 years ago.

As I was searching about divorce in Dubai, I found a post here saying that if I didn't convert to Islam within the period of 3 months our marriage will be void in the Islamic law. It's been 5 years since we separated. My question is, do we need to file a divorce here in Dubai so I can find another love and marry again? What processes do I need to start and if we do need to divorce, how much will it cost here in Dubai?

    Thanks for writing to us.

    Technically, your marriage is void, as a long time has passed since her conversion to Islam. If you choose to accept Islam by choice, you could remarry with her.

    But if you choose to stay non Muslim, you can not return to her. Whether you can marry another lady or not is something Islam has no answer for, because you are not Muslim. And I do not think the UAE auhorities will restrict you from marrying another lady.

  2. As far as the cost, I think that's a legal issue. I surely wouldn't know... Perhaps seek the advice of an attorney or Imam.
