My wife left me without letting me know, I forced myself into her house

Living Separately

Good Afternoon Sheikh,

me and my wife have separation since December 2011, after two weeks she left my home and took another house and of course my daughter with her, all that happened without letting me know anything and any permission from my side at all,

I kept very calm in order to try to work things back between us then after 5 months I forced myself and moved to her house but I’m living in a room and she’s in another room with the kid, I have tried all the ways to get her back and to be a normal husband and wife but nothing is working at all. my questions are:

-  Is she still my wife according to Islam and sonny till date?

-  Is the Islam allowing the separation all that time without Nikkah?

-  Is she considered Najiz after leaving my house without permission?

-  What’s the best way to deal with her at the moment?

  1. Asalam ailikum brother,
I think we need to know first some reasons why she left first before anyone can help you. Tell some events that led to separation.

In sha Allah you two come back together.
    Salam

  2. assalamaialaikum

1st you are still wife and husband.
2nd seperation has not taken place.
    3rd no nikah is needed
4th-she is still jayez for you and you for her

THE BEST SOLUTION IS FOR YOU TO TALK TO THE ELDERS OF BOTH SIDES AND MAKE THEM TALK TO HER AND SAVE THE DAUGHTERS FUTURE BECASUE SHE IS ACTING LIKE CHILD I THINK HER AGE MIGHT BE 20YRS- OR LESS THAN THAT.

NIKAH IS DONE WITH GAWAH[WITNESS]AND WALI AND THAT IS THE THEIR DUTY TO COME IN TO THE PICTURE NOW AND MAKE HER UNDERSTAND THAT THIS IS NOT DOLLS OR CHILDS PLAY .

IT IS HAS TO BE HANDLED PROPERLY OR ELSE IN EVERY HOUSE THERE WILL BE DIVORCEES IF LEFT ON THE 2 AND NOT GIVEN A GOOD ADVICE GIVE A GOOD TURN THE RELATIONSHIP WILL COLAPSE AND YOU UST TAKE THE STAND THAT THE DAUGHTERS IS AT NO FAULT TO SUFFER IN THIS ATTITUDE OF THE MOTHER/IF SHE GETS THE MOTHER SHE WILL NOT GET FATHER AND OF GETS FATHER SHE WONT GET A MOTHER.

DONT LET HER IGNORANCE WIN THIS MATTER- THE ELDERS ALSO WILL FAVOUR YOU IF YOU ARE NOT AT FAULT IN THE MAINTENANCE/EXPENCES/CARING AND LOVING THE ROLE AS A HUSBAND.

    HOPE FOR THE BEST

    REGARDS

  3. As-salamu alaykum brother Haytham,

It sounds to me like you are presenting only one side of the story. Why did your wife feel the need to leave your home? Is she asking for divorce?
