Are we still married or not?

Divorce decree Asalamualikum,

I need some advice so I can move on with my life. Me and my wife married a few years ago and we have a daughter.
About one year ago she left me and married someone else. They have a child together, but what left me confused is how can her second nikah be valid? Although they are no longer together anymore, I am still confused in where I stand. Are we still married, or was our Nikah broken when she left me without ever getting a divorce?
Any advice would be much appreciated.

  1. I would be very interested to see replies to your posting.. I think her 2nd marriage was probably illegal to be a practising muslim.

    If you never gave her a talaq at any point, then it is my understanding that you are still in fact married. There is no recognition in Islam of a second marriage for a woman if she has not gotten a divorce for the first one, so what she did would be considered as adultery.

    If I were you, I would give her the talaq as soon as possible. Someone capable of doing something like that is not trustworthy (in my opinion) and it would not be good judgment on your part to try to maintain a marriage with her. Honestly, it would have been best if you had gone ahead and given her the talaq as soon as you knew she was this involved with someone else.
