Married in Court But not Married in Islamic way in a Mosque

My wife and I got married in American Court but not Married in Islamic way in a Mosque and we had sex,  I know we sinned.

Now we are trying to get married in Islamic way.

Is it too late or can we still go to a Mosque and get married?

    I am not100% on this and so I would advise that you speak to a professional Imam about this issue to get a more reliable response.

    To my knowledge the requirements of a valid marriage as I know them, are that you must announce your marriage, have two witness's, a Wali for the bride and some kind of formal ceremony, and publisizing of the marriage, usually accompanied by some kind of feast and the marriage must be performed by a qualified person who is authorised to validate your marriage by - so if you have done these things, (which most likely you have done through the Civil way) then I think your marriage is valid.

    That aside, I would advise that you perform the mosque ceremony as well, as it is an important part of the way that we feel about our marriage, and no doubt give you much ease in your heart.

    If anyone knows of a resource, mistake or correction to be made here - please do step in.

    • Leyla, everything you said is correct but you missed two important requirements: mutual consent of the bride and groom, and payment of the mahr (or agreement on a schedule of payment).

        • Max r, mahr is a payment that the groom gives to the bride, as a gift and as security against future instability or divorce. The amount is determined mutually by the groom and bride. Payment of the mahr is a condition for marriage in Islam.

          Quoting from this article on Zawaj.com:

          The marriage-gift (Mahr) is a divine injunction. The giving of mahr to the bride by the groom is an essential part of the contract.

          'And give the women (on marriage) their mahr as a (nikah) free gift" (Quran 4:4)

          Mahr is a token commitment of the husband's responsibility and may be paid in cash, property or movable objects to the bride herself. The amount of mahr is not legally specified, however, moderation according to the existing social norm is recommended. The mahr may be paid immediately to the bride at the time of marriage, or deferred to a later date, or a combination of both. The deferred mahr however, falls due in case of death or divorce.

          One matrimonial party expresses 'ijab" willing consent to enter into marriage and the other party expresses 'qubul" acceptance of the responsibility in the assembly of marriage ceremony. The contract is written and signed by the bride and the groom and their two respective witnesses. This written marriage contract ("Aqd-Nikah) is then announced publicly.

  3. There is no doubt you committed sin.But you could still marry the girl (SHE IS STILL NOT YOUR WIFE AS YOU DIDNT HAVE NIKAH). First thing to be done is to have nikah in a proper islamic way and before which you should repent for your sin (ALSO GIRL INVOLVED).You must not live together before nikah its haram and fornication (ZENA).

    May ALLAH forgive all yours sin and guide you to proper path.

Marriage is a social contract in Islam. it is not necessary to get married in mosque. but you can get marry anywhere, if the Islamic speech of marriage ( Khotba-ton- nekah) and it conditions has performed, which needs to witnesses, Sadagh for wife , etc., then you did not make any mistake or sin.
    Otherwise, you must ask this question from your Islamic Clergy or Jurist ( Faghih or Mofti), because may be the Fatvas differed between Islamic branches and schools. you must ask this question, because if your wife has got pregnant, the baby conditions have to be defined , weather he or she will be able to get your inheritance or not. However, in any case, this baby will be yours, and you must pay his Islamic rights to him or her, as put a good name for him or her, rise him or her up , educate him or her by Quran, etc. only about the inheritance, you must ask question as mentioned.
