What are my rights in divorcing my Christian husband?

Salaams,

I am married to a man who basically converted to Islam just so as to marry me, but he has never practised Islam, and even admits to have only converted just to marry me, he is Christian. We have been for  along time, but I am thinking of leaving as much as it hurts, but I have decided to live an Islamic life, which is basically impossible to do while living with a non muslim man. What I would like to know is this:  we have a daughter together (a toddler) and I am pregnant, we have some savings toghether and even two flats,.

When we divorce Islamically,  if he shared a part of his wealth with me am I allowed to take it or not? I was wondering because he's not only non-Muslim but also because 80 percent of the wealth was earned from haram money, selling alcohol and pork.

Please help me.

  1. Dear Sister,

I am sorry for the difficulty you are experiencing. May Allah(swt) make things easy for you, aameen.

If you are sure that this man is not Muslim, then your marriage is automatically in-valid. If due to this, your marriage is in-valid, you really need to separate from him immediately because he is non-mahram to you.

I do not know what happens with regards to the division of money so I will advise you to consult with a qualified imam as soon as possible.
