Property problem

Allah's Law

Assalamualaikum brothers and sisters my parents has a property issue which I want to ask..

It is related to my grandparents, they have five children- two sons and three daughters which includes my mother. The issue is my late grandmother had named property to both her sons, now the situation is one son (my uncle) wants the property to divide only between brothers and not their sisters and the other uncle wants to distribute property under muhammadan laws between all the children, so they have a dispute which has been going for a long time and matter is stuck... so what is solution to this problem under sharia law?

Sharia inheritance laws make provision for men and women to inherit, so it doesn't sound appropriate for three children to be denied any inheritance due to their sex. I'm not a legal expert, though, so it may be that you need to discuss the issue with a lawyer in your country. But, it sounds like there's some tension between family members - it might help to get people to attend a mediation service, to see if everyone can come to an arrangement (that might also be cheaper than a lawsuit).

Remember that money and physical possessions won't come with us into the grave, or speak well of us on the Day of Judgement. Try to keep people from losing perspective on this, and remind your family of the bonds between them that are much deeper than money.

    • waalaikumassalam, the thing is four children (3 daughters and 1 son) understands shariah but the other brother doesn't understand all of that, he publicly states that he wants to divide under indian law which is between sons but he doesnt even do that he wants all four siblings's share which is totally greedy and ridiculuous..i already suggested to have a lawyer which can assist on that but being a kid at home is not my decision. all the elders they just dont want to do any lawsuit, they often talk in an arranged meetings bt them and that's it they havent come to any conclusion within 5 years...
